Is there any way the use prohibited weapons? States can engage in arm conflict with each other but this right has restrictions. The law of armed conflict aims to prohibit certain types of weapons, such as nuclear weapons, biological weapons, chemical weapons, poisonous weapons, and gases. If the use of weapons has an uncontrollable impact and causes large civilian losses, its use should be prohibited. Art. 50 of Genova Convetion manslaughter, torture, or cruel treatment, including biological experiments, as well as massive property destruction and theft that are not authorized by a compelling military need and are carried out illegally and willfully[1]. To analyze this concept better it is necessary to give examples like the Syrian one. In recent years ınvestigators found out that the Syrian regime was responsible for a poison gas attack that killed 43 people in a suburb of Damascus around 2018. To give more details the attack was taken at a place on the 7th of April 2018 Organization for the Prohibition of Chemical Weapons(OPCW) found a canister which contains the gas of cholerine which is super harmful to human health. These changes were dropped by the Syrian government. There were several witnesses however after this incident occur no one was allowed and allegedly they cleansed the area in order to remove the contaminants[2]. The use of chemical weapons is prohibited in international armed conflicts in a series of treaties, including the Hague Declaration concerning Asphyxiating Gases, the Geneva Gas Protocol, the Chemical Weapons Convention, and the Statute of the International Criminal Court. Considering the incident in Syria, use of such weapons will lead to death of all people in that region regardless of whether they are civilian, or military and the Use of chemical weapons is not acceptable for IHL. The Chemical Weapons Convention forbids the use of chemical weapons in all situations, including in domestic and regional armed conflicts.[3] Not only it is target specific, but also it leads to the death of innocent people. one of the main purposes of forbidden these weapons is to prevent the possible harms which can happen to civilians. So that there is no change the justificate use of these weapons.
